Driveway repairs in a Victorian rental: who pays, how fast, and when the 14 day clock starts

The rental provider pays. Under the Residential Tenancies Act 1997 the driveway is part of the rented premises, so keeping it in good repair is an owner obligation, not a renter one, unless the renter caused the damage. If it makes the property unsafe it is an urgent repair and must be arranged immediately. Everything else is non-urgent with a 14 day deadline from written notice. Where the driveway sits in the Victorian rules

The Residential Tenancies Act 1997 and the reforms that took effect in 2021 give the rental provider a general duty to keep the rented premises in good repair and fit for occupation. The driveway is part of the premises. It is not carved out, and there is no clause that makes the renter responsible for the condition of the concrete they park on.

Worth knowing, because agents get asked: the Victorian rental minimum standards, which sit in the residential tenancies regulations and cover things like locks, heating, ventilation, lighting, structural soundness and the state of the kitchen and bathroom, do not list driveways as a separate standard. That does not let an owner off the hook. The general repair duty still applies, and so does the separate obligation not to let the premises become unsafe. In practice a driveway problem is dealt with under the repair rules and the safety rules, not the minimum standards list.

Urgent versus non-urgent is the distinction that decides everything. Victoria has a defined list of urgent repairs, and the catch-all that matters for driveways is any fault or damage that makes the premises unsafe. A void under the slab, a collapsed panel, a hole a child could step into, a trip lip on the only path to the front door, or serious flooding running into the garage all land there. Urgent repairs must be arranged immediately, and the renter has the right to arrange them up to $2,500 themselves if they cannot reach the provider or agent, with reimbursement due within 7 days of written notice.

Everything else is a non-urgent repair. The renter gives written notice, and the rental provider has 14 days to carry it out. If the 14 days pass, the renter can ask Consumer Affairs Victoria to inspect and report, and the matter can then be taken through the Victorian rental dispute process. Nobody wants to be there over a $900 concrete panel, and the 14 days is genuinely achievable: a single panel replacement is 2 to 5 working days from go-ahead, and crack sealing is a half day.

Notice, access and the parking problem

Driveway work is external, so the tradesperson rarely needs to enter the dwelling. Access to the property for repairs still requires the correct written notice, generally 24 hours, with entry between 8am and 6pm and not on a public holiday unless the renter agrees. Urgent repairs are the exception and can be attended straight away.

The practical issue is parking, not entry. A concrete driveway is out of action for longer than people expect: no foot traffic for 24 hours, no light vehicles for 7 days, no heavy vehicles or trailers for 28 days. On a Pakenham or Officer estate block with no rear access and restricted street parking, that is a real inconvenience for the renter. Tell them the dates in writing before the pour, offer a temporary plank or path for pedestrian access, and expect a reasonable conversation about rent reduction if the loss of use runs longer than about a week. Agreeing that up front is much cheaper than arguing about it afterwards.

The vacate inspection: what you can and cannot charge for

Almost every driveway dispute at the end of a tenancy comes down to one thing: whether the condition report and the photographs at the start of the tenancy show the driveway as it was. If they do not, the claim is very hard to run.

Fair wear and tear, which you cannot charge for: concrete that has greyed, a sealer that has dulled, hairline cracking, seasonal joint movement on reactive clay, faded oxide colour on an older coloured slab, and light tyre scuffing. Concrete in Pakenham weathers. A five year old driveway is not supposed to look new.

Damage or lack of cleanliness, which you can raise: oil and transmission fluid staining that was not there at the start, paint or concrete spills, chemical burns from an unrinsed cleaner, a broken edge where a trailer jockey wheel has punched through, and gouging from a tracked machine or steel-wheeled trailer. The realistic figure to claim is what it costs to clean or repair that specific damage, which is $150 to $450 for a pressure clean and degrease, or $650 to $2,400 for an edge rebuild. It is not the cost of a new driveway.

Two practical habits fix most of this. Photograph the driveway properly at every routine inspection, wide plus close-ups, with the date on. And if the driveway is already marked at the start of a tenancy, write it into the condition report in words as well as photos, because a grey photograph of grey concrete proves very little on its own.

Repair or capital improvement: the tax line, in plain words

This is general information and your accountant decides your situation, but the distinction is worth understanding before you approve the work, because it changes the after-tax cost.

A repair restores something that has deteriorated or been damaged, back to the condition it was in, using modern equivalent materials. Replacing two cracked panels in an existing driveway, routing and sealing joints, grinding a lip, or fixing a section washed out by a stormwater failure would generally be treated as a repair and deducted in the year you pay for it. That is the cheapest outcome after tax.

A capital improvement makes the asset better than it was, or replaces the whole thing. Ripping out the entire driveway and pouring a new one, widening it, or upgrading plain grey concrete to exposed aggregate or coloured concrete generally falls into capital works, written off at 2.5 per cent a year over 40 years. On a $9,000 driveway that is $225 a year, not a $9,000 deduction.

There is a third trap. Work done to fix defects that already existed when you bought the property, known as initial repairs, is generally capital even if it looks like a repair, and goes to the cost base rather than a deduction. If you have just settled on an investment property in Pakenham East or Cardinia Lakes and the driveway was already cracked at inspection, get advice before you book the work.

The planning point that follows: staging matters. Two panels this financial year and two the next may be treated very differently from a full replacement in one go. Talk to your accountant with the quote in front of you, and ask us to itemise the scope so the repair and improvement components are separated on the invoice.

What to put in the work order, if you want one price and no delays

  • Property address, suburb and whether there is rear or side access for a truck and a pump.
  • The renter name and the best contact number, plus whether they work from home. Access is the single biggest cause of a rebooked pour.
  • Photographs: wide from the street, close-up with a tape measure, and one of the garage threshold.
  • Whether you want a make safe today or a quote for programmed work. These are different visits at different prices.
  • The owner approval limit you hold. Most management agreements allow $300 to $500 without owner sign-off, which covers a make safe but not a panel.
  • Whether the driveway is under a builder warranty. Estate homes in Pakenham East, Lakeside and Officer built in the last few years often still are, and the builder should be chased first.

The honest constraint: when we tell an owner not to spend

Three situations where we will recommend the cheaper option, even though it is less work for us.

A cracked but level driveway does not need replacing. If the panels are stable and nothing traps water, route and seal at $250 to $900 and photograph it for the file. That keeps the property safe and the obligation met for years. A $9,000 replacement on a rental is an owner decision about the asset, not a repair obligation.

Check the cause before you approve concrete. If a panel keeps dropping, the base or the drainage has failed and repouring the same slab spends the money twice.
