Cardinia crossover work needs Council permission before the driveway is built

The actual instruments that matter
The crossover and road reserve side sits under Victoria’s road management framework. Transport Victoria says consent is required to work within the road reserve unless an exemption applies under the Road Management Act 2004 or the Road Management (Works and Infrastructure) Regulations 2015. Cardinia Shire is the local road authority for many residential streets in Pakenham, Officer, Cardinia Lakes and Lakeside, so its Works Within a Road Reserve permit is the practical gateway for most crossover work.
The building and contract side is separate. The Building Act 1993 and Building Regulations 2018 sit behind Victorian building controls. The Domestic Building Contracts Act 1995 controls domestic building contracts, including major domestic building contracts. Consumer Affairs Victoria lists the major domestic building contract threshold at $10,000, deposit caps of 10 per cent under $20,000 and 5 per cent at $20,000 or more, and domestic building insurance rules over $16,000 where they apply.
The main Australian Standards to ask about are AS 2870-2011 Residential slabs and footings for site classification and slab thinking, AS/NZS 2890.1:2004 Parking facilities for vehicle access grades and layout principles, and AS 4586 for slip resistance testing where a surface needs a nominated slip performance. Not every driveway quote needs an engineer’s report, but a contractor should know when slope, clay movement, vehicle load or drainage pushes a job beyond a basic slab.
There is no general Victorian rebate for resurfacing or replacing a private driveway in 2026. The relevant "scheme" for most homeowners is not a rebate, it is domestic building insurance and the dispute pathway if domestic building work goes wrong. That is why paperwork matters even when the job feels like outdoor concrete rather than a house renovation.
What needs a Cardinia crossover permit
Cardinia Shire says if you want to install, upgrade or repair your driveway crossover, you need permission first. The crossover is the section from the edge of the road to your property boundary. It can include kerb, channel, nature strip and footpath. This is not only about new builds. A homeowner replacing an old driveway in Pakenham East or widening an entry in Officer can trigger the same permit if the road reserve is touched.
Inside-boundary work is different. Replacing or resurfacing concrete wholly inside your land may not need a road reserve permit if the crossover, footpath, kerb and nature strip are left alone. You still need to think about drainage, contracts, registration, public liability and any estate covenant. Lakeside, Cardinia Lakes and new estates can have finish or frontage expectations that are not the same as Council’s road reserve permit.
Permit timing matters because concrete bookings, demolition and curing have to line up. Cardinia lists processing up to 28 business days. That is why a quote that promises a new crossover next week should be checked carefully. Urgent work on a damaged crossover can still need permission, and traffic or pedestrian management may be needed depending on the street.

What goes wrong at sale time or claim time
At sale time, the practical problem is uncertainty. A buyer, conveyancer or building inspector may ask whether the crossover was approved, especially where a kerb was cut, a footpath was disturbed, or a second driveway entry was added. If the work does not match Council requirements, the seller can be pushed into rectification or a price negotiation. A rectification can be much more expensive than the original permit fee because demolition, kerb reinstatement, footpath works and traffic control may be involved.
At claim time, insurers look at cause and compliance. If water damage, trip injury or vehicle damage is linked to non-compliant drainage, an unapproved crossover or poor workmanship, the paperwork can matter. No page can promise how an insurer will decide a claim, but missing permits and vague invoices make the conversation harder. At dispute time, the written scope is the evidence. If the quote said 100 mm concrete, SL72 mesh, compacted base and saw cuts, that can be checked against the finished work. How to ask for the right registration and paperwork
Ask who is contracting with you, who is supervising, and whether the work requires a registered building practitioner. Where registration applies, check the Building and Plumbing Commission register for the individual, not just the brand. For slab and footing work, the BPC describes a Domestic Builder Limited to footings and slab work class, and a Domestic Builder Unlimited can also be relevant depending on the scope.
Ask for public liability insurance. Ask whether domestic building insurance is required if the job is over $16,000. Ask who lodges the Cardinia Works Within a Road Reserve permit if the crossover is included. Ask whether the price includes Council permit fees, inspections, kerb works, disposal and reinstatement of the nature strip. These questions are normal, not difficult.
You do not need to over-complicate a small private resurface. If the job is entirely inside your boundary, under the main contract thresholds, and the slab only needs a clean and coating, the paperwork should be proportionate.
